9th November 2005
The Department of Finance and Personnel, in exercise of the powers conferred upon it by Article 1(2) and (5) of the Law Reform (Miscellaneous Provisions) (Northern Ireland) Order 2005(1), and of all other powers enabling it in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Law Reform (Miscellaneous Provisions) (2005 Order) (Commencement and Transitional Saving) Order (Northern Ireland) 2005.
(2) In this Order, “the 2005 Order” means the Law Reform (Miscellaneous Provisions) (Northern Ireland) Order 2005.
2.—(1) The day appointed for the coming into operation of the following provisions of the 2005 Order, namely—
(a)Articles 3 to 15;
(b)Articles 20 and 21;
(c)Schedule 1 (Consequential Amendments); and
(d)Article 24 and Schedule 2 (Repeals), except to the extent they repeal the Colonial Solicitors Act 1900(2) and Article 5(5) of the Solicitors (Northern Ireland) Order 1976(3),
is 15th November 2005.
(2) The day appointed for the coming into operation of the following provisions of the 2005 Order, namely—
(a)Article 19; and
(b)the repeals of the Colonial Solicitors Act 1900 and Article 5(5) of the Solicitors (Northern Ireland) Order 1976 in Schedule 2,
is 1st February 2006.
3. The repeals of the Colonial Solicitors Act 1900 and Article 5(5) of the Solicitors (Northern Ireland) Order 1976 shall not affect any notice given before 1st February 2006 under section 1 of that Act by a person seeking admission as a solicitor in Northern Ireland (so that any subsequent procedure relating to such a notice continues as if the repeals had not been effected).

This Order brings into operation on 15th November 2005, Articles 3 to 15, 20 and 21 of the Law Reform (Miscellaneous Provisions) (Northern Ireland) Order 2005 (N.I. 17) (“the 2005 Order”). The Order also brings into operation on 1st February 2006, Article 19 of the 2005 Order. Relevant repeals and consequential amendments are also brought into operation by this Order.
Articles 3 to 9 of the 2005 Order relate to changes to the law relating to deeds and other instruments.
Articles 10 to 15 of the 2005 Order amend certain provisions contained in the Family Homes and Domestic Violence (Northern Ireland) Order 1998 (N.I. 6).
Article 19 of the 2005 Order repeals the Colonial Solicitors Act 1900 (c. 14).
Articles 20 and 21 of the 2005 Order repeal the Trading Stamps Act (Northern Ireland) 1965 (c. 6) and provide for the amendment of legislation to make provision for trading stamps.
The Order also contains transitional saving provision.
