The Department for Employment and Learning, in exercise of the powers conferred by Articles 4(8) and 14(4) of the Higher Education (Northern Ireland) Order 2005(1) makes the following Regulations.

Citation, commencement and interpretation

1.  These Regulations may be cited as the Student Fees (Qualifying Courses and Persons) (2006 Regulations) (Amendment) Regulations (Northern Ireland) 2007 and shall come into operation on 15th August 2007.

2.  In these Regulations, “the 2006 Regulations” means the Student Fees (Qualifying Courses and Persons) Regulations (Northern Ireland) 2006(2).

Amendment of the 2006 Regulations

3.  The 2006 Regulations shall be amended as provided by regulations 4 and 5.

4.  In regulation 2, for the definition of “Student Support Regulations” there shall be substituted—

Student Support Regulations” means the Education (Student Support) Regulations (Northern Ireland) 2006, as amended by the Education (Student Support) Regulations (Northern Ireland) 2006, the Education (Student Support) Regulations (Northern Ireland) 2007 and the Education (Student Support) (Amendment) Regulations (Northern Ireland) 2007.

5.  In regulation 4—

(a)in paragraph (2) for the words “and (4)” there shall be substituted “, (4) and (4A)”;

(b)after regulation 4(4) there shall be inserted—

(4A) Paragraph (2) does not apply where the qualifying course is a course leading to a degree in social work at an educational institution in Northern Ireland.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Student Fees (Qualifying Courses and Persons) Regulations (Northern Ireland) 2006 to comply with article 9 of Decision No 1/80 of the Association Council of 19th September 1980 on the development of the Association between the European Community and Turkey.

The Association Council was created by the agreement establishing an association between the European Community and Turkey which was signed in Ankara on 12th September 1963 by the Republic of Turkey on the one hand and the Member States of the EEC and the Community on the other. The agreement was concluded, approved and confirmed on behalf of the Community by Council Decision 64/732/EEC of 23 December 1963 (OJ 1973 c 113 p l).

Article 9 of Decision No 1/80 of the Association Council of 19th September 1980 on the development of the association provides: “Turkish children residing legally in a Member State of the Community with their parents who are or have been legally employed in that Member State, shall be admitted to courses of general education, apprenticeship and vocational training under the same educational entry qualifications as the children of nationals of that Member State. They may in that Member State be eligible to benefit from the advantages provided for under the nation legislation in this area”.

Regulation 4 defines the Student Support Regulations. These include the Education (Student Support) (Amendment) Regulations 2007. The definition of a child of a Turkish worker has been defined in those Regulations

Regulation 5 corrects a drafting omission to now include Social Work degree students with a previous honours degree as a qualifying person.
