Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 3 and Transitional Provisions) Order 2008

The Secretary of State makes the following Order, in exercise of the powers conferred by Articles 1(4) and 100(4) of the Criminal Justice (Northern Ireland) Order 2008(1):

Citation and Interpretation

1.—(1) This Order may be cited as the Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 3 and Transitional Provisions) Order 2008.

(2) In this Order—

(a)“the 2008 Order” means the Criminal Justice (Northern Ireland) Order 2008; and

(b)“the 1996 Order” means the Criminal Justice (Northern Ireland) Order 1996(2).

Commencement

2.  The provisions of the 2008 Order specified in the Schedule to this Order shall come into operation on 6th October 2008.

Transitional Provisions

3.  Any summons or warrant issued under Schedule 2 of the 1996 Order before the commencement of Article 47 of the 2008 Order shall continue to have effect under Schedule 2 of the 1996 Order as if Article 47 had not been commenced.

6.  In Schedule 6 (Repeals) Part 1 the entry relating to Schedule 2 to the Criminal Justice (Northern Ireland) Order 1996.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation on 6th October 2008 provisions of the Criminal Justice (Northern Ireland) Order 2008 dealing with guidance to agencies on assessing and managing certain risks to the public and changes to the enforcement of certain court orders made on conviction.

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The following provisions of the 2008 Order have been brought into operation by earlier Commencement Orders as from the date shown.
