Citation and interpretation

1.  This Order may be cited as the Education (1998 Order) (Commencement No. 6) Order (Northern Ireland) 2009.

2.  In this Order—

“the 1986 Order” means the Education and Libraries (Northern Ireland) Order 1986 (2);

“the 1989 Order” means the Education Reform (Northern Ireland) Order 1989 (3);

“the 1993 Order” means the Education and Libraries (Northern Ireland) Order 1993 (4); and

“the 1996 Order” means the Education and Libraries (Northern Ireland) Order 1996 (5).

Appointed day

3.  The following provisions of the Education (Northern Ireland) Order 1998 shall come into operation on 31^st May 2009, that is to say—

(a)Article 91 (1) in so far as it relates to the amendments in Part II of Schedule 5 mentioned in paragraph (d);

(b)Article 91 (2) in so far as it relates to the repeals in Part II of Schedule 6 mentioned in paragraph (e);

(c)Schedule 2;

(d)Part II of Schedule 5 in so far as it relates to the amendment of Articles 16, 58, 88, 119A of the 1986 Order, Article 125 (2)(g)(ii) of the 1989 Order and Article 39 (4)(b) to the 1996 Order;

(e)Part II of Schedule 6 in so far as it relates to the repeal of—

(i)Articles 8, 69A, 70 (4)(a) and (c), 72 and 116 of the 1986 Order;

(ii)Article 2 (5) of, and Schedule 4 to, the 1989 Order;

(iii)the amendments to Articles 69 and 72 of the 1986 Order in Schedule 9 to the 1989 Order;

(iv)Articles 28 (1), (5) and (6) and 31 (1) to (3) of the 1993 Order;

(v)the amendment to Article 62 of, and Schedule 4 to, the 1989 Order in Part II of Schedule 4 to the 1993 Order;

(vi)the amendments to the 1986 Order and the 1989 Order in Schedule 1 to the Employment Rights (Northern Ireland) Order 1996 (6);

(vii)Article 25 (7) of the Education (Northern Ireland) Order 1997 (7); and

(viii)the amendments to Article 46 of the 1989 Order in Schedule 4 to the Further Education (Northern Ireland) Order 1997 (8).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation the following Articles of the Education (Northern Ireland) Order 1998: Article 91(1) and (2) which allows for the commencement of specified provisions of Part II of Schedule 5 and Part II of Schedule 6 (repeals and amendments); and Schedule 2 which makes provisions relating to the staff of controlled and maintained schools with delegated budgets. This Order also commences a number of other amendments and repeals.
