Coming into operation
The Department of Health, Social Services and Public Safety1 makes the following Regulations in exercise of the powers conferred by Articles 42, 98, 106 and 107(6) of, and Schedule 15 to, the Health and Personal Social Services (Northern Ireland) Order 19722, in conjunction with the Department of Finance and Personnel insofar as they relate to the Provision of Health Services to Persons not Ordinarily Resident and with the approval of the Department of Finance and Personnel insofar as they relate to Charges for Drugs and Appliances.
Citation, commencement and interpretation1

These Regulations may be cited as the Charges for Drugs and Appliances and Provision of Health Services to Persons not Ordinarily Resident (Amendment) Regulations (Northern Ireland) 2009 and shall come into operation on 9th May 2009.

In these Regulations—
a
“the Charges for Drugs and Appliances Regulations” means the Charges for Drugs and Appliances Regulations (Northern Ireland) 19973;
b
“the Provision of Health Services to Persons not Ordinarily Resident Regulations” means the Provision of Health Services to Persons not Ordinarily Resident Regulations (Northern Ireland) 20054.
Amendment of the Charges for Drugs and Appliances Regulations (Northern Ireland) 19972

The Charges for Drugs and Appliances Regulations are amended as follows.

In regulation 5 (supply of drugs and appliances by the Regional Board or an HSC trust)—
a
in paragraph (1), for “subject to paragraphs (2) and (2A)” substitute “subject to paragraphs (2), (2A) and (2B)”, and
b
after paragraph (2A) insert the following paragraph—
2B
No charge shall be made and recovered under this regulation in respect of a supply which is—
a
made—
i
while a disease is, or
ii
in anticipation of a disease being imminently,
pandemic and a serious risk, or potentially a serious risk, to human health; and
Amendment of the Provision of Health Services to Persons not Ordinarily Resident Regulations (Northern Ireland) 20053
In Schedule 1 (Diseases for the treatment of which no charge is to be made) to the Provision of Health Services to Persons not Ordinarily Resident Regulations, after “mumps” insert the following entry—
Pandemic influenza (influenza caused by a new virus subtype that has an increased and sustained transmission during a global outbreak of influenza).

The Department of Finance and Personnel hereby approves the foregoing Regulations insofar as they relate to Charges for Drugs and Appliances.
