The Department of Education, in exercise of the powers conferred by Articles 37(6) (c) and (d) and 49(4) of the Special Educational Needs and Disability (Northern Ireland) Order 2005(1), after consultation with such persons as appear to the Department to be appropriate in accordance with Article 39(2) of that Order, makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Special Educational Needs and Disability (General Qualifications Bodies) (Relevant Qualifications, Reasonable Steps and Physical Features) (Amendment) Regulations (Northern Ireland) 2009 and shall come into operation on 25th February 2009.

Amendment of the Special Educational Needs and Disability (General Qualifications Bodies) (Relevant Qualifications, Reasonable Steps and Physical Features) Regulations (Northern Ireland) 2008

2.—(1) The Special Educational Needs and Disability (General Qualifications Bodies) (Relevant Qualifications, Reasonable Steps and Physical Features) Regulations (Northern Ireland) 2008(2) are amended as provided by paragraph (2).

(2) In regulation 3 after paragraph (2) add—

(3) Where a general qualifications body grants an exemption in accordance with paragraph (1), it is always a reasonable step for the general qualifications body to have to take to assess the candidate only in relation to those components of the examination or assessment for which the candidate has not been granted an exemption as if those components comprised the entire examination or assessment..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations specify that it is always a reasonable step to assess the disabled candidate in relation to the components of an examination taken by him as if those components comprised the entire examination.
