The Foyle, Carlingford and Irish Lights Commission, with the approval of the North/South Ministerial Council, makes the following Regulations in exercise of the powers conferred by section 13(1) and (2) of the Foyle Fisheries Act 1952(1) and section 13(1) and (2) of the Foyle Fisheries Act (Northern Ireland) 1952(2) and now vested in it(3).

Citation and commencement

1.  These Regulations may be cited as the Foyle Area and Carlingford Area (Licensing of Fishing Engines) (Amendment) Regulations 2009 and shall come into operation on 1st July 2009.

Amendment of the Foyle Area and Carlingford Area (Licensing of Fishing Engines) Regulations 2001

2.  The Foyle Area and Carlingford Area (Licensing of Fishing Engines) Regulations 2001(4) are amended in accordance with regulations 3 and 4.

3.  For the Schedule substitute the Schedule set out in the Schedule.

4.  In regulations 6, 7(4) and 8(4) for “Part III” substitute “Part II”.

Revocations

5.  Regulations 5, 7(3) and 8(3) of the Foyle Area and Carlingford Area (Licensing of Fishing Engines) Regulations 2001 are revoked.

6.  The Foyle Area and Carlingford Area (Licensing of Fishing Engines) (Amendment No.2) Regulations 2007 (5) are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Foyle Area and Carlingford Area (Licensing of Fishing Engines) Regulations 2001 (“the 2001 Regulations”) by —

(a)removing references to drift nets used wholly to seaward of Lough Foyle, and drift nets used partly in Lough Foyle and partly seaward of the seaward limit of Lough Foyle;

(b)removing references to draft nets used wholly in the waters of the Foyle Area elsewhere than in the tidal waters of the River Foyle or the River Roe upstream of the defined mouth;

(c)removing references to stake nets and to bag nets and fixed draft nets;

(d)introducing a concessionary coarse fishing rod and line licence for a person holding a season coarse fishing rod and line licence issued by the Fisheries Conservancy Board for Northern Ireland;

(e)introducing a juvenile coarse fishing rod and line licence;

(f)making consequential amendments to ensure references are consistent with amendments to the Schedule.
