The Magistrates’ Courts Rules Committee makes the following Rules in exercise of the powers conferred by Article 13 of the Magistrates’ Courts (Northern Ireland) Order 1981(1), after consultation with the Lord Chancellor and with the agreement of the Lord Chief Justice.
1. These Rules may be cited as the Magistrates’ Courts (Criminal Justice (Children)) (Amendment) Rules (Northern Ireland) 2009 and shall come into operation on 30th September 2009.
2. After Rule 18 of the Magistrates’ Courts (Criminal Justice (Children)) Rules (Northern Ireland) 1999(2) insert—
“18A. A summons to enforce the attendance of a parent or guardian in accordance with Article 15 of the Order may be served in the same manner as a summons to be served under Rule 12A of the Magistrates’ Courts Rules (Northern Ireland) 1984(3).”

These Rules amend the Magistrates’ Courts (Criminal Justice (Children)) Rules (Northern Ireland) 1999 [S.R.1999 No. 7] to provide that service of a summons to enforce the attendance of a parent or guardian under Article 15 of the Criminal Justice (Children) (Northern Ireland) Order 1998 may be effected by post.
S.I. 1981/1675 (N.I.26); Article 13 was amended by Schedule 5, paragraph 65 of the Constitutional Reform Act 2005 (c.4).
