The Department for Social Development, makes the following Order in exercise of the powers conferred by Article 55(5) and (6) of the Private Tenancies (Northern Ireland) Order 2006(1).
The Department has accepted the recommendation of the Rent Officer made under Article 55(4) of that Order that the rents referred to in Article 55(1) of that Order should be increased.
1. This Order may be cited as the Registered Rents (Increase) Order (Northern Ireland) 2009, and shall come into operation on 19th October 2009.
2.—(1) Subject to paragraph (2) a rent
(a)entered on the Register of Rents, during the period beginning on 2nd April 2007 and ending on 6th April 2008, shall be increased by 5.9 percent; and
(b)entered on the Register of Rents, during the period beginning on 7th April 2008 and ending on 5th April 2009, shall be increased by 1.95 percent.
(2) The provision at paragraph (1) does not apply to a rent entered on the Register of Rents during those periods unless a certificate of fitness has also been issued during those periods except where such a certificate is not required.

This Order increases the rents registered during the period beginning on 2 April 2007 and ending on 4 April 2008 and during the period beginning on 7 April 2008 and ending on 3 April 2009 unless a certificate of fitness has been issued for that period, except where such a certificate is not required under Part IV of the Private Tenancies (Northern Ireland) Order (“the Order”) by 5.9 percent and 1.95 percent respectively from 19th October 2009.
A landlord must give a tenant at least 4 weeks’ notice of the increase in accordance with Article 49 of the Private Tenancies (Northern Ireland) Order 2006.
