1. These Regulations may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment and Use) (Amendment) Regulations (Northern Ireland) 2009 and shall come into operation on 16th November 2009.
2. For regulation 45 of the Public Service Vehicles (Conditions of Fitness, Equipment and Use) Regulations (Northern Ireland) 1995(3) (repair outfit) substitute—
“45.—(1) Subject to paragraph (2), the licensee of a taxi shall cause the taxi to be provided with—
(a)a tyre fully inflated mounted on a spare rim or wheel, such tyre being suitable for use in accordance with regulation 32(1) of the Construction and Use Regulations, an efficient lifting jack and a wheelbrace or similar tool; or
(b)a post-puncture repair kit in the case of a vehicle which is supplied by the manufacturer with no facility for the carriage of a spare wheel.
(2) Paragraph (1) shall not apply to a taxi which is fitted with tyres which are suitable for use in accordance with regulation 32(2) of the Construction and Use Regulations.”.

These Regulations further amend the Public Service Vehicles (Conditions of Fitness, Equipment and Use) Regulations (Northern Ireland) 1995 so as to permit a taxi to carry a post-puncture tyre repair kit where the vehicle has not been constructed with the facility to carry a spare wheel.
