Coming into operation-

1. These Regulations may be cited as the Further Education (Student Support) (Eligibility) (Amendment) Regulations (Northern Ireland) 2009 and shall come into operation on 1st December 2009.
2.—(1) The Further Education (Student Support) (Eligibility) Regulations (Northern Ireland) 2009(4) shall be amended as provided by paragraph (2).
(2) For Regulation 5 (Designated courses) substitute—
“5. A course is a designated course for the purposes of Article 3(1) of the Order if it is—
(a)a further education course or a higher education course; and
(b)wholly provided by an institution of further education in Northern Ireland.”.

These Regulations amend the Further Education (Student Support) (Eligibility) Regulations (Northern Ireland) 2009 (“the 2009 Regulations”).
They substitute a new Regulation 5 in the 2009 Regulations. They amend the definition of a designated course so providing for financial support towards tuition fees to institutions of further education, in respect of courses of less than one academic year’s duration, for students who are domiciled in a part of the United Kingdom other than Northern Ireland, in the European Community, or the European Economic Area, but are studying at Colleges of Further Education in Northern Ireland.

Article 5(b) and Part 11 of Schedule 3 to the Departments (Transfer and Assignment of Functions) Order 1998 from the Department of Education to the Department of Higher and Further Education, Training and Employment, now rename the Department for Employment and Learning.
