The Foyle, Carlingford and Irish Lights Commission, with the approval of the North/South Ministerial Council, makes the following Regulations in exercise of the powers conferred by section 13(1) of the Foyle Fisheries Act 1952 (1) and section 13(1) of the Foyle Fisheries Act (Northern Ireland) 1952 (2) and now vested in it (3).

Citation and commencement

1.  These Regulations may be cited as the Foyle Area and Carlingford Area (Angling) (Amendment) Regulations 2009 and shall come into operation on 1st January 2010.

Amendment of the Foyle Area and Carlingford Area (Angling) Regulations 2001

2.—(1) The Foyle Area and Carlingford Area (Angling) Regulations 2001(4) are amended in accordance with paragraphs 2 and 3.

(2) In regulation 4 (prohibitions and restrictions) for paragraph (1) substitute—

(1) A person shall not angle for fish in or from any waters of the River Roe, River Faughan, Clanrye River, River Finn, River Strule or the River Mourne described in Schedule 2.

(3) For Schedule 2 (areas where angling is prohibited) substitute the Schedule set out in the Schedule.

FisheryWaters in which Angling is Prohibited
River Roe
(a)

All waters downstream of the weir known as Cahan’s Rock in the townland of Deerpark, County Londonderry for 45.8 metres.

(b)

All waters downstream of the weir known as Givens Weir in the townland of Terrydremond, County Londonderry for 45.8 metres.

River Faughan
(a)

All waters downstream of the weir known as Ballyarton Weir in the townland of Lettermuck, County Londonderry for 91.5 metres.

(b)

All waters downstream of the weir known as Bleachgreen Weir in the townland of Ardmore, County Londonderry for 91.5 metres, measured from an imaginary straight line drawn at right angles to the course of the river through the right or eastern bank extremity of the weir.

(c)

All waters downstream of the Department for Regional Development’s barrage in the townland of Campsie, County Londonderry for 54.9 metres on the left or western side and for 123.5 metres on the right or eastern side of the river.

River Mourne

All waters on the right or eastern side of the river downstream of the weir at Sion Mills in the townlands of Camus and Liggartown, County Tyrone to a point 25 metres downstream of the boundary between the townlands of Camus and Bearney Glebe, County Tyrone, and all waters on the left or western side of the river downstream of the said weir for 64 metres.

River Finn

All waters upstream of Cloghan Bridge in the townlands of Gortiness and Cloghanmore, County Donegal to an imaginary straight line drawn at right angles to the course of the river between Irish Grid reference points H0425597785 and H0427397762.

River Strule

All waters downstream of (and including the waters underneath) Bells Bridge in Omagh, County Tyrone, to (and including the waters underneath) Abbey Bridge in Omagh, County Tyrone.

Clanrye RiverAll waters upstream of the weir known as Thompson’s Weir in the townlands of Lisdrumgullion and Carneyhough, County Down, for 25 metres and all waters downstream of the said weir for 25 metres.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These regulations amend the Foyle Area and Carlingford Area (Angling) Regulations 2001 by prohibiting angling on stretches of the Rivers Mourne, Strule and Clanrye adjacent to fish counters and their associated dams.
