The Fair Employment (Specification of Public Authorities) (Amendment) Order (Northern Ireland) 2009

The Office of the First Minister and deputy First Minister(1) makes the following Order in exercise of the powers conferred by Articles 50 and 51 of the Fair Employment and Treatment (Northern Ireland) Order 1998(2) and now vested in it(3).

Citation and commencement

1.  This Order may be cited as the Fair Employment (Specification of Public Authorities) (Amendment) Order (Northern Ireland) 2009 and shall come into operation on 1st January 2010.

Amendment of the Fair Employment (Specification of Public Authorities) Order (Northern Ireland) 2004

2.  For the Schedule to the Fair Employment (Specification of Public Authorities) Order (Northern Ireland) 2004(4) substitute the Schedule set out in the Schedule to this Order.

Revocations

3.  The following Orders are revoked—

(a)the Fair Employment (Specification of Public Authorities) (Amendment) Order (Northern Ireland) 2007(5),

(b)the Fair Employment (Specification of Public Authorities) (Amendment) Order (Northern Ireland) 2008(6).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Fair Employment (Specification of Public Authorities) Order (Northern Ireland) 2004 (“the 2004 Order”) which specifies a number of persons or bodies as public authorities for certain purposes under Part VII of the Fair Employment and Treatment (Northern Ireland) Order 1998 (“the 1998 Order”).

The Schedule to the 2004 Order lists in Part I the bodies who are public authorities for the purposes of Articles 52 to 65 of the 1998 Order and in Part II the bodies who are public authorities for the purposes of Articles 62 to 65 of the 1998 Order.

Article 2 of this Order substitutes a new Schedule to the 2004 Order.

The following bodies are added to Part I of the Schedule:

Northern Ireland Library Authority

Patient and Client Council

Regional Agency for Public Health and Social Well-being

Regional Business Services Organisation

Regional Health and Social Care Board

The following bodies have been deleted from Part I of the Schedule:

Eastern Health and Social Services Board

Fisheries Conservancy Board for Northern Ireland

Flexibus Limited

Mental Health Commission for Northern Ireland

Northern Health and Social Services Board

Northern Ireland Central Services Agency for the Health and Social Services

Northern Ireland Health Promotion Agency

Northern Ireland Regional Medical Physics Agency

Southern Health and Social Services Board

Western Health and Social Services Board

The following amendments have also been made to Part I of the Schedule:

The Belfast Health and Social Services Trust is now listed as the Belfast Health and Social Care trust.

The Northern Ireland Ambulance Service Health and Social Services Trust is now listed as the Northern Ireland Ambulance Service Health and Social Care trust.

The Northern Health and Social Services Trust is now listed as the Northern Health and Social Care trust.

The Northern Ireland Health and Personal Social Services Regulation and Improvement Authority is now listed as the Health and Social Care Regulation and Quality Improvement Authority.

The South Eastern Health and Social Services Trust is now listed as the South Eastern Health and Social Care trust.

The Southern Health and Social Services Trust is now listed as the Southern Health and Social Care trust.

The Western Health and Social Services Trust is now listed as the Western Health and Social Care trust.

Article 3 revokes the Fair Employment (Specification of Public Authorities) (Amendment) Order (Northern Ireland) 2007 and the Fair Employment (Specification of Public Authorities) (Amendment) Order (Northern Ireland) 2008.
