The Department for Social Development makes the following Order in exercise of the powers conferred by section 36(2) and (3) of the Welfare Reform Act (Northern Ireland) 2010(1).
Citation and interpretation
1.—(1) This Order may be cited as the Welfare Reform (2010 Act) (Commencement No. 3) Order (Northern Ireland) 2011.
(2) In this Order—
“the Act” means the Welfare Reform Act (Northern Ireland) 2010;
“the 1995 Order ” means the Jobseekers (Northern Ireland) Order 1995(2).
Appointed day
2. 20th June 2011 is the day appointed for the coming into operation of the following provisions of the Act—
(a)section 26(1) (contracting out functions under Jobseekers (Northern Ireland) Order 1995) in so far as is necessary for the purposes of paragraphs (b) and (c) of this Article;
(b)section 26(2), but only in so far as it confers power to make regulations under Article 22E(3) of the 1995 Order (contracting out) in relation to the functions of the Department and the Department for Employment and Learning under regulations under Article 19A (schemes for assisting persons to obtain employment: “work for your benefit” schemes etc.) of the 1995 Order, and
(c)section 26(2) in so far as it relates to Article 22E(4) to (12) of the 1995 Order, but only in so far as those provisions apply in connection with or for the purposes of regulations under Article 22E(3) of the 1995 Order in relation to the functions of the Department and the Department for Employment and Learning under regulations under Article 19A of the 1995 Order.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings into operation the following provisions of the Welfare Reform Act (Northern Ireland) 2010—
a)
section 26(1) (contracting out functions under Jobseekers (Northern Ireland) Order 1995) in so far as it relates to certain provisions in section 26(2) below, and
b)
section 26(2) (contracting out), in so far as it is necessary in relation to regulations to enable the Department’s and the Department for Employment and Learning’s functions under regulations under Article 19A of the Jobseeker’s (Northern Ireland) Order 1995 (the 1995 Order) (schemes for assisting persons to obtain employment: “work for your benefit” schemes etc.) to be exercised by other persons.
Section 26(1) amends the 1995 Order and section 26(2) inserts a new Article 22E into that Order. Article 22E of the 1995 Order allows the Department to make regulations which enable persons to be authorised to exercise functions of the Department and the Department for Employment and Learning.
