The Department of Culture, Arts and Leisure (1), makes the following Regulations in exercise of the powers conferred by section 26(1) of the Fisheries Act (Northern Ireland) 1966 (2).

Citation and commencement

1.  These Regulations may be cited as the Fisheries (Amendment) Regulations (Northern Ireland) 2011 and shall come into operation on 1st November 2011.

Amendment of the Fisheries Regulations (Northern Ireland) 2003

2.  The Fisheries Regulations (Northern Ireland) 2003 (3) are amended as provided by regulation 3.

List of waters where there is no close season for rainbow trout

3.  In Schedule 6 in the list of rainbow trout waters where there is no annual close season for angling for rainbow trout —

(a)under the heading County Antrim insert before the reference to “Kilgad Fishery” a reference to “Green Road Mill Ponds, Ballyclare”;

(b)under the heading County Down the reference to “Loughinisland Lake, Downpatrick” shall be removed;

(c)under the heading County Londonderry insert before the reference to “Dunalis Reservoir” a reference to “Cromore Road Fishery, Portstewart”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Fisheries Regulations (Northern Ireland) 2003.

The Regulations designate two waters as rainbow trout waters for the purposes of regulation 73(2)(b) of the Fisheries Regulations (Northern Ireland) 2003 which provides that there shall be no close season for angling for rainbow trout in waters so designated and remove Loughinisland Lake, Downpatrick from Schedule 6 which lists those waters (regulation 3).

By virtue of section 1(3)(b) of, and paragraph 3(1)(c) of Part 2 of Schedule 1 to, the Public Authorities (Reform) Act (Northern Ireland) 2009 references to “byelaws” in the Fisheries Act (Northern Ireland) 1966 are now to “regulations”.
