The Plant Health (Amendment) Order (Northern Ireland) 2012

The Department of Agriculture and Rural Development(1), in exercise of the powers conferred by section 3(1)(2) of the Plant Health Act (Northern Ireland) 1967(3), makes the following Order:

Citation and Commencement

1.  This Order may be cited as the Plant Health (Amendment) Order (Northern Ireland) 2012 and shall come into operation on 26th April 2012.

Amendment to the Plant Health Order (Northern Ireland) 2006

2.—(1) Schedule 14 to the Plant Health Order (Northern Ireland) 2006(4) shall be amended in accordance with paragraphs 2(2) and 2(3).

(2) Part A, paragraph 1, for the definition of “safety zones” substitute ““safety zone” means any premises in respect of which a notice is served under Article 32.”

(3) Part B shall be deleted.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Plant Health Order (Northern Ireland) 2006 by removing certain townlands previously scheduled as safety zones to protect against spread of potato wart disease (PWD). Previously the varieties of potatoes grown in these townlands were restricted, by the Plant Health Order (Northern Ireland) 2006, to PWD resistant types. The Order lifts restrictions on the growing of potatoes in the former safety zones as provided in Article 2 of Directive 98/57/EC. There are now no townlands scheduled for PWD.
