The Department of Justice, in exercise of the powers conferred by section 25 of the Police (Northern Ireland) Act 1998(1), makes the following Regulations. Those powers are now vested in the Department(2).

The Department has taken into consideration the recommendations made by the Police Negotiating Board for the United Kingdom and supplied the Board with a draft of the Regulations in accordance with section 62(1ZA) of the Police Act 1996(3).

Citation and commencement

1.  These Regulations may be cited as the Police Service of Northern Ireland (Amendment) Regulations 2012 and shall come into operation on 27th May 2012.

Amendment of the Police Service of Northern Ireland Regulations 2005

2.—(1) The Police Service of Northern Ireland Regulations 2005(4) shall be amended in accordance with paragraph (2).

(2) In regulation 3(1) in paragraph (a) of the definition of “public holiday”, for 2012 only, for the words “and last Monday in May” substitute “,4th and 5th June”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police Service of Northern Ireland Regulations 2005 to allow for the public holiday on the last Monday in May to be replaced by public holidays on 4th and 5th June to mark Her Majesty the Queen’s Diamond Jubilee.

1998 c.32. Relevant amendments are made by section 78(1) of and paragraph 23 of Schedule 6 to the Police (Northern Ireland) Act 2000.

Article 5 of and paragraph 9 of Schedule 3 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order (S.I. 2010/976) transferred the regulation making powers of the Secretary of State to the Department of Justice.

1996 c.16. Section 62(1ZA) was inserted by article 5 of and paragraph 7(3) of Schedule 3 to S.I. 2010/976.
