Citation and interpretation

1.—(1) This Order may be cited as the Safeguarding Vulnerable Groups (2007 Order) (Commencement No. 7) Order (Northern Ireland) 2012.

(2) In this Order “the Order” means the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007.

Provisions coming into operation on 10th September 2012

2.  The appointed day for the coming into operation of the following provisions of the Order is 10th September 2012—

(a)Article 45(6);

(b)Article 45(7) insofar as it is not already in operation;

(c)Article 49(1) to (4)(2);

(d)Article 49(7)(3) insofar as it is not already in operation;

(e)Article 52(4) (provision of information to supervisory authorities) insofar as it is not already in operation.

Provisions coming into operation on the day on which paragraph 9 of Schedule 7 to the Protection of Freedoms Act 2012 comes into force

3.  Schedule 5 to the Order (insofar as it is not already in operation) comes into operation on the day on which paragraph 9 of Schedule 7 to the Protection of Freedoms Act is brought into force for the purposes of inserting Article 32A (provision of barring information on request) into the Order.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation further provisions of the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007 (“the 2007 Order”).

Article 2 brings into operation on 10th September 2012 provisions in the 2007 Order relating to provision of information from the Independent Safeguarding Authority (“ISA”) to keepers of relevant registers and the ability for supervisory authorities to request information and be provided with information by the ISA.

Article 3 brings into operation provisions in the 2007 Order relating to the list of persons who will be entitled to request barred list information from the ISA at the same time as the provisions in the 2007 Order which enable that barred list check to be done are brought into operation. These are inserted by paragraph 9 of Schedule 7 to the Protection of Freedoms Act 2012 (“the 2012 Act”) and will be brought into operation by a commencement order made under the 2012 Act at a later date.
