The Attorney General’s Human Rights Guidance (Protection of Life) Order (Northern Ireland) 2013

The Attorney General:

(a)has, in pursuance of section 8(1) of the Justice (Northern Ireland) Act 2004, issued guidance on human rights standards relevant to the protection of the right to life in respect of the Public Prosecution Service for Northern Ireland, the Probation Board for Northern Ireland, the Police Ombudsman for Northern Ireland, the Department of Justice (functions of the Department mentioned in section 69(1) of the Judicature (Northern Ireland) Act 1978(1) and functions of the Department(2) exercised by the Northern Ireland Prison Service, the Youth Justice Agency, Forensic Science Northern Ireland, the State Pathologist’s Department and the Compensation Agency);

(b)has, in accordance with section 8(3)(a) of the Justice (Northern Ireland) Act 2004, published that guidance on his website;

(c)has, in accordance with section 8(3)(b) of that Act, laid that guidance before the Northern Ireland Assembly(3);

(d)has, in accordance with section 8(1A) and section 8(5A) of that Act, consulted the Advocate General for Northern Ireland(4).

The Attorney General, in exercise of powers conferred by section 8(3)(c) of that Act, makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Attorney General’s Human Rights Guidance (Protection of Life) Order (Northern Ireland) 2013 and shall come into operation on 24th June 2013.

(2) The Interpretation Act (Northern Ireland) 1954 shall apply to this Order as it applies to an Act of the Assembly(5).

Coming into operation of the guidance

2.  The guidance on human rights standards relevant to the protection of the right to life in respect of the Public Prosecution Service for Northern Ireland, the Probation Board for Northern Ireland, the Police Ombudsman for Northern Ireland, the Department of Justice (functions mentioned in section 69(1) of the Judicature (Northern Ireland) Act 1978 and functions of the Department exercised by the Northern Ireland Prison Service, the Youth Justice Agency, Forensic Science Northern Ireland, the State Pathologist’s Department and the Compensation Agency) shall come into operation on the day on which this Order comes into operation.

This Order brings into operation guidance by the Attorney General for Northern Ireland, pursuant to section 8 of the Justice (Northern Ireland) Act 2004, which was laid before the Assembly on 22nd March 2013.
