Citation and commencement

1.  This Order may be cited as the Emergency Grants (Eligible Tenants) (Amendment) Order (Northern Ireland) 2013 and shall come into operation on 1^st August 2013.

Amendment of the Emergency Grants (Eligible Tenants) Order (Northern Ireland) 2004

2.  For Article 2 of the Emergency Grants (Eligible Tenants) Order (Northern Ireland) 2004(2), substitute:

“Specified tenancies

2.—(1) For the purposes of Article 29A(2)(c) of the Housing (Northern Ireland) Order 1988 (scheme for emergency grants), the following are descriptions of tenancies to which Article 29A applies:

(a)an introductory tenancy within the meaning of Article 6 of the Housing (Northern Ireland) Order 2003(3); and

(b)a private tenancy, other than a protected tenancy or a statutory tenancy.

(2) In this Article, “private tenancy” means any tenancy except:—

(a)a tenancy under which the estate of the landlord belongs to:—

(i)the Crown (whether in right of Her Majesty’s Government in the United Kingdom or in Northern Ireland);

(ii)a government department;

(iii)the Executive;

(iv)a registered housing association;

or is held in trust for Her Majesty for the purposes of a government department.

(b)a tenancy the purpose of which is to confer on the tenant the right to occupy a dwelling house for a holiday.”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Article 29A of the Housing (Northern Ireland) Order 1988 (scheme for emergency grants) requires the Housing Executive to comply with a scheme for paying grants to eligible tenants who are unable or unwilling to occupy their homes as a consequence of acts of violence etc.

This Order adds private sector tenancies which are not protected or statutory tenancies to the descriptions of tenancies specified in Article 29A(2) of the 1988 Order and in the Emergency Grants (Eligible Tenants) Order (Northern Ireland) 2004.
