The Scottish Ministers make the following Order in exercise of the powers conferred by section 6(1)(b)(ii) and (2) of the Statistics and Registration Service Act 2007(1) and all other powers enabling them to do so.
In accordance with section 6(3) of that Act, they have consulted the Statistics Board.
In accordance with section 65(6)(a) of that Act(2), a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1. This Order may be cited as the Official Statistics (Scotland) Amendment Order 2012 and comes into force on the day after the day on which it is made.
2. For article 2 (official statistics) of the Official Statistics (Scotland) Order 2008(3) substitute—
“2.—(1) Subject to paragraph (2), wholly Scottish devolved statistics(4) produced, or to be produced, by the persons listed in the Schedule are specified as official statistics for the purposes of section 6(1)(b) of the Statistics and Registration Service Act 2007.
(2) In relation to Sustrans Limited(5), only statistics produced, or to be produced, on behalf of the Scottish Ministers are so specified.”.
3. In the Schedule to the Official Statistics (Scotland) Order 2008, where alphabetically appropriate, insert the persons listed in the Schedule to this Order.

This Order specifies that wholly Scottish devolved statistics produced, or to be produced, by the persons listed in the Schedule are official statistics. “Scottish devolved statistics” is defined in section 66 of the Statistics and Registration Service Act 2007 (“the 2007 Act”).
This Order amends the Official Statistics (Scotland) Order 2008 by adding five additional persons to the list of persons specified as producers of official statistics. In relation to Sustrans Limited, only statistics produced or to be produced by Sustrans on behalf of the Scottish Ministers are specified as official statistics for the purposes of section 6 of the 2007 Act (article 2).
Statistics specified are specified in addition to official statistics produced by the Statistics Board, a government department, the Scottish Administration, a Welsh ministerial authority, a Northern Ireland department, or any other person acting on behalf of the Crown, under section 6(1)(a) of the Statistics and Registration Service Act 2007, or specified in another order under that section.
A full Business and Regulatory Impact Assessment has not been produced for this instrument as it has no impact on the cost of business.
