The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Potatoes Originating in Egypt (Scotland) Amendment Regulations 2002 and shall come into force on 13th December 2002.
2.—(1) The Potatoes Originating in Egypt (Scotland) Regulations 2001(2) are amended in accordance with paragraph (2).
(2) In the Schedule–
(a)in the column headed “Instrument”, after the entry “Commission Decision 2001/664/EC”, there is added the entry “Commission Decision 2002/903/EC”(3); and
(b)in the column headed “Reference”, after the entry “O.J. No. L 233, 31.08.01, p.49”, there is added the entry “ O.J. No. L 312, 15.11.02, p.28”.

These Regulations implement in Scotland Commission Decision 2002/903/EC (O.J. No. L 312, 15.11.02, p.28) amending Commission Decision 96/301/EC (“the principal Decision”) (O.J. No. L 115, 9.5.96, p.47) authorising Member States temporarily to take emergency measures against the dissemination of Pseudomonas solanacearum (Smith) Smith (now referred to as Ralstonia solanacearum (Smith) Yabuuchi et al.) as regards Egypt. The Regulations add Commission Decision 2002/903/EC to the list of instruments amending the principal Decision contained in the Schedule to the Potatoes Originating in Egypt (Scotland) Regulations 2001 (S.S.I. 2001/421) (regulation 2). Decision 2002/903/EC renews the framework within which potatoes may be imported from Egypt into the territory of the European Community during the 2002/2003 season.
No Regulatory Impact Assessment has been carried out in respect of the extension of these controls to the 2002/2003 season.
1972 c. 68; section 2(2) was amended by the Scotland Act 1998 (c. 46), Schedule 8, paragraph 15(3). The function conferred upon the Minister of the Crown under section 2(2) of the European Communities Act 1972, insofar as within devolved competence, was transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.
