The Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Commencement No. 3) Order 2004

The Scottish Ministers, in exercise of the powers conferred by section 21(2) and (3) of the Public Appointments and Public Bodies etc. (Scotland) Act 20031, hereby make the following Order:

Citation1

This Order may be cited as the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Commencement No. 3) Order 2004.

Commencement2

The day appointed for the coming into force of–

a

sections 1, 2 and 3; and

b

schedules 1 and 2

of the Public Appointments and Public Bodies etc. (Scotland) Act 2003 is 1st June 2004.

The Public Appointments and Public Bodies etc. (Scotland) Act 2003 (“the Act”) received Royal Assent on 11th March 2003.

This Order brings into force the provisions of sections 1, 2 and 3 to the Act which provides for the establishment of the Office of Commissioner for Public Appointments in Scotland and outlines the Commissioner’s functions.

This Order also brings into force schedules 1 and 2 to the Act.

Schedule 1 makes further provision about the appointment and status of the Commissioner and details certain administrative matters relating to the Office of the Commissioner.

Schedule 2 lists those public bodies that are subject to the code of practice for public appointments prepared by the Commissioner.
