The Scottish Ministers, in exercise of the powers conferred by section 95(3) and (4) of the Agricultural Holdings (Scotland) Act 2003(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation

1.  This Order may be cited as the Agricultural Holdings (Scotland) Act 2003 (Commencement No. 4) Order 2004.

Appointed day for certain provisions

2.  15th December 2004 is appointed as the day for the coming into force of Part 2 of the Agricultural Holdings (Scotland) Act 2003 (tenant’s right to buy land) insofar as not already in force.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 15th December 2004 Part 2 of the Agricultural Holdings (Scotland) Act 2003 (“the Act”) relating to a tenant’s right to buy land, insofar as that Part of the Act is not in force immediately before that date. On 15th December 2004 all provisions of the Act will be in force. The provisions of that Part in force at that date are only the provisions which allow the Scottish Ministers to make orders or regulations or issue guidance for the operation of the right to buy.

The Act received Royal Assent on 22nd April 2003. The following provisions of the Act have been brought into force by commencement order made before the date of this Order–
