This Order makes modification (including, where appropriate, repeals) to enactments having effect in Scotland. These modifications are consequential and supplemental to the Mental Health (Care and Treatment) (Scotland) Act 2003 (asp 13) (“the 2003 Act”). The Order also makes modification to the 2003 Act to ensure that the purposes of the 2003 Act may be fully achieved and that full effect is given to the provisions of the Act.
The modifications are set out in Schedule 1 to the Order, which Schedule has effect in accordance with article 2 of the Order. The repeals are set out in Schedule 2 which Schedule has effect in accordance with article 3 of the Order.
