These Regulations, which apply in relation to Scotland only–largely revoke and replace the Feeding Stuffs (Scotland) Regulations 2000 as amended, (“the 2000 Regulations”);introduce new provisions to enforce and administer Regulation (EC) No. 1831/2003 on additives for use in animal nutrition (“the Additives Regulation”); andimplement Commission Directive 2004/116/EC amending the Annex to Council Directive 82/471/EEC as regards the inclusion of Candida guilliermondii.

PART IIIEnforcement
Modification of section 74A(3) of the Agriculture Act 1970I123

For the purposes of the enforcement and administration of the provisions specified in paragraph (2), section 74A(3) is to have effect as if for “imposed by regulations under subsection (1) above, or fails to comply with any other provision of the regulations,” there was substituted “or fails to comply with any requirement imposed by any provision specified in regulation 23(2) of the Feeding Stuffs (Scotland) Regulations 2005”.

The provisions specified for the purposes of paragraph (1) are regulations 12(1), 13(2) to (9), 14(1) to (4), 15(1), 16(1) and (2), 17, 18(1), 19(1), 20(1) and 21(1).
