Part 3 does not apply in relation to products that are brought into Scotland from means of transport operating internationally and that had been intended for consumption by the crew or passengers on that means of transport.

Any person who has in their possession or under their control a product referred to in paragraph (1) must comply with Article 4(2) and (3) of Regulation (EC) No. 1774/2002.

Where items such as packaging materials, or disposable cutlery or plates–
a
have been in contact with a product referred to in paragraph (1); and
b
are unloaded from the means of transport for disposal,
the person referred to in paragraph (2) must ensure that those items are dealt with in the same way as the products themselves.
