The Scottish Ministers, in exercise of the powers conferred by sections 49D(3) and (4) and 67(3)(a) of the Disability Discrimination Act 1995(1), and of all other powers enabling them in that behalf, having consulted the Disability Rights Commission and the Secretary of State in accordance with section 49D(5) and (9) of that Act, hereby make the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Disability Discrimination (Public Authorities) (Statutory Duties) (Scotland) Amendment Regulations 2007 and shall come into force on 1st April 2007.

(2) In these Regulations, “the 2005 Regulations” means the Disability Discrimination (Public Authorities) (Statutory Duties) (Scotland) Regulations 2005(2).

Amendment of the 2005 Regulations

2.  In Part I of the Schedule to the 2005 Regulations, in appropriate alphabetical order, insert–

(a)“the British Waterways Board in respect of its Scottish functions”;

(b)“A Chief Officer of a relevant authority appointed under section 7 of the Fire (Scotland) Act 2005(3)”;

(c)“The Commissioner for Children and Young People in Scotland”;

(d)“The Construction Industry Training Board in respect of its Scottish functions”;

(e)“Learning and Teaching Scotland”;

(f)“The Mental Welfare Commission for Scotland”; and

(g)“A Transport Partnership created by an order under section 1(1) of the Transport (Scotland) Act 2005(4)”.

Modification of the 2005 Regulations: publication date

3.  For the purpose of publication of a Disability Equality Scheme under regulation 2(1) of the 2005 Regulations by the authorities listed in regulation 2 above, “the relevant publication date” shall be read as a reference to 3rd December 2007.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Disability Discrimination (Public Authorities) (Statutory Duties) (Scotland) Regulations 2005 (“the 2005 Regulations”) by adding to the Schedule the Scottish authorities and two cross border public authorities (the British Waterways Board and the Construction Industry Training Board) listed in regulation 2.

The 2005 Regulations impose duties upon specified authorities to publish a Disability Equality Scheme, implement stipulated components of the scheme and publish reports in relation to that implementation.

The Scottish authorities and cross border public authorities added to the 2005 Regulations by virtue of these Regulations will, in terms of regulation 3, be required to publish a Scheme on or before 3rd December 2007.
