The Scottish Ministers, in exercise of the power conferred by section 55(1) of the Animal Health and Welfare (Scotland) Act 2006(1), hereby make the following Order:

Citation

1.  This Order may be cited as the Animal Health and Welfare (Scotland) Act 2006 (Commencement No. 2) Order 2007.

Appointed day

2.  The appointed day for the coming into force of section 20(1) to (3) of the Animal Health and Welfare (Scotland) Act 2006 is 30th April 2007.

Explanatory Note

(This note is not part of the Order)

This Order provides that the appointed day for the coming into force of section 20(1) to (3) of the Animal Health and Welfare (Scotland) Act 2006 (asp 11) (“the Act”) is 30th April 2007. These subsections provide for various offences in relation to the mutilation of animals.

Note as to Earlier Commencement Orders

The Act received Royal Assent on 11th July 2006. Sections 53 to 55 came into force on Royal Assent. The first commencement order, the Animal Health and Welfare (Scotland) Act 2006 (Commencement No. 1, Savings and Transitional Provisions) Order 2006 (S.S.I. 2006/482) was made on 28th September 2006. The provisions of the Act commenced by that Order are detailed in the table below.

The provisions of the Act remaining to be commenced after the making of this Order are section 52 insofar as introducing paragraphs 6, 9(b), (d) (insofar as not already in force), (h) to (l), (n), and (p) of schedule 2 to the Act. These provisions shall be commenced once secondary legislation has been made to replace the provisions of the primary legislation to be repealed by them.
