The Scottish Ministers make the following Order in exercise of the powers conferred by section 59(2) of the Planning etc. (Scotland) Act 2006(1) and all other powers enabling them to do so.

Citation and commencement

1.  This Order may be cited as the Planning etc. (Scotland) Act 2006 (Commencement No. 4) Order 2008 and comes into force on 16th May 2008.

Commencement

2.  Section 55(2) (further amendment of the listed buildings Act) of the Planning etc. (Scotland) Act 2006 comes into force on 1st June 2008.

Amendment of the Planning etc. (Scotland) Act 2006 (Commencement No. 3) Order 2008

3.—(1) The Planning etc. (Scotland) Act 2006 (Commencement No. 3) Order 2008(2) is amended in accordance with paragraph (2).

(2) In article 1(3) and in column 3 of the Schedule for “strategic development plan authority” in each place where those words occur substitute, “strategic development planning authority”.

Explanatory Note

(This note is not part of the Order)

This Order brings section 55(2) of the Planning etc. (Scotland) Act 2006 (“the Act”) into force on 1st June 2008.

It also amends the Planning etc. (Scotland) Act 2006 (Commencement No. 3) Order 2008 to correct references to the strategic development planning authority.

The Act received Royal Assent on 20th December 2006.
