The Homelessness etc. (Scotland) Act 2003 (Commencement No. 3) Order 2008

The Scottish Ministers make the following Order in exercise of the powers conferred by section 14(1) and (2) of the Homelessness etc. (Scotland) Act 2003(1).

Citation

1.  This Order may be cited as the Homelessness etc. (Scotland) Act 2003 (Commencement No. 3) Order 2008.

Commencement of provisions

2.  Section 11 of the Homelessness etc. (Scotland) Act 2003 comes into force–

(a)on 2nd October 2008 for the purpose of making regulations; and

(b)on 1st April 2009 for all purposes.

Explanatory Note

(This note is not part of the Order)

Section 11 of the Homelessness etc. (Scotland) Act 2003 makes provision for notice to be given to local authorities by landlords and heritable creditors when proceedings for possession of a dwellinghouse are raised or certain other actions are taken by creditors.

This Order brings into force the provisions contained in section 11 on 2nd October 2008 for the purpose of making regulations prescribing the forms of notices referred to in that section. Section 11 is brought fully into force on 1st April 2009.
