The Scottish Ministers make the following Order in exercise of the powers conferred by sections 1 and 2A of the Inshore Fishing (Scotland) Act 1984(1) and all other powers enabling them to do so.

In accordance with section 1(1) of the Inshore Fishing (Scotland) Act 1984 they have consulted with such bodies as they consider appropriate.

Citation and commencement

1.  This Order may be cited as the Inshore Fishing (Prohibition on Fishing) (Lamlash Bay) (Scotland) Order 2008 and shall come into force on 20th September 2008.

Prohibition on fishing

2.—(1) Subject to paragraph (2), all fishing for sea fish is prohibited within that part of the Scottish zone(2) bounded by a straight line from Mount Pleasant Farm (55 degrees 32.603 minutes North, 005 degrees 06.512 minutes West) in a south to south easterly direction to Holy Isle West (55 degrees 31.556 minutes North, 005 degrees 05.216 minutes West) thence in an easterly direction around the northern end of Holy Island by the mean high water mark of ordinary spring tides to Holy Isle East (55 degrees 31.876 minutes North, 005 degrees 04.304 minutes West); thence by a straight line in a north to north westerly direction to Hamilton Rock (55 degrees 33.000 minutes North, 005 degrees 04.823 minutes West); thence in a west to north westerly direction by a straight line to Clauchlands Point (55 degrees 33.002 minutes North, 005 degrees 04.957 minutes West); and thence in a west to south westerly direction by the mean high water mark of ordinary spring tides to Mount Pleasant Farm.

(2) The prohibition in paragraph (1) does not apply to any fishing for sea fish carried out by, or authorised by, the Scottish Ministers for the purpose of scientific investigation.

Explanatory Note

(This note is not part of the Order)

This Order, made under sections 1 and 2A of the Inshore Fishing (Scotland) Act 1984 prohibits fishing in Lamlash Bay, being the area set out in article 2(1) of the Order. A map showing the area closed to fishing under this Order is appended to this note for illustrative purposes only.

By virtue of section 4 of the Inshore Fishing (Scotland) Act 1984, any person who contravenes a prohibition contained in this Order shall be guilty of an offence and liable on summary conviction to a fine of up to £5,000, and on conviction on indictment to an unlimited fine.
