EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations repeal and replace with amendments the provisions of the Town and Country Planning (Determination of Appeals by Appointed Persons) (Prescribed Classes) (Scotland) Regulations 1987. Regulations 3, 4 and 5 prescribe the classes of appeal which are to be determined by persons appointed for the purpose by the Scottish Ministers instead of being determined by the Scottish Ministers. Regulation 6 prescribes certain classes of appeal within those prescribed under regulation 3 which are to continue to be determined by the Scottish Ministers. Regulation 7 provides for publication by planning authorities of any direction made by the Scottish Ministers specifying classes of case within the prescribed classes which are to be determined by the Scottish Ministers.

Regulation 3 also extends the classes of delegated appeals to cover the determination of appeals under section 75B and 75F of the Town and Country Planning (Scotland) Act 1997 (c.8) relating, respectively, to the variation or discharge of planning obligations and good neighbour agreements.
