LEGAL AID AND ADVICE

These Regulations—amend the Legal Aid (Scotland) Act 1986 (“the Act”) to increase the financial limits of eligibility for advice and assistance and civil legal aid;amend the Act to increase the financial thresholds beyond which a person may be required to make payments in respect of advice and assistance and contributions in respect of civil legal aid;prescribe the maximum amount of those payments and, in respect of income, contributions; andallow advice and assistance to be made available in certain circumstances without reference to the financial limits of eligibility.

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 8A, 11(2), 17(2)(a) and 36(2)(b) of the Legal Aid (Scotland) Act 19861 and all other powers enabling them to do so.

In accordance with section 37(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
