The Budget (Scotland) Act 2012 Amendment Order 2013

The Scottish Ministers make the following Order in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2012(1) and all other powers enabling them to do so.

In accordance with section 7(2) of that Act, a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Budget (Scotland) Act 2012 Amendment Order 2013 and comes into force on 31st March 2013.

(2) In this Order, “the Act” means the Budget (Scotland) Act 2012.

Amendment of amounts specified in section 4 (overall cash authorisations)

2.  In section 4 of the Act, for the amount specified—

(a)in subsection (2) (Scottish Administration), substitute “£31,178,566,000”;

(b)in subsection (3)(a) (Forestry Commissioners), substitute “£66,750,000”; and

(c)in subsection (3)(b) (Food Standards Agency), substitute “£9,830,000”.

Amendment of schedule 1 (the Scottish Administration)

3.—(1) In schedule 1 to the Act, in column 2, for the amount specified—

(a)in relation to purpose 1, substitute “203,786,000”;

(b)in relation to purpose 2, substitute “442,708,000”;

(c)in relation to purpose 3, substitute “11,857,138,000”;

(d)in relation to purpose 4, substitute “2,934,607,000”;

(e)in relation to purpose 5, substitute “1,850,249,000”;

(f)in relation to purpose 6, substitute “447,547,000”;

(g)in relation to purpose 7, substitute “2,662,937,000”;

(h)in relation to purpose 8, substitute “10,518,998,000”;

(i)in relation to purpose 10, substitute “2,633,766,000”;

(j)in relation to purpose 11, substitute “239,731,000”;

(k)in relation to purpose 12, substitute “22,604,000”;

(l)in relation to purpose 13, substitute “108,470,000”;

(m)in relation to purpose 14, substitute “89,871,000”;

(n)in relation to purpose 15, substitute “2,950,000”; and

(o)in the final row, in relation to the total amounts of resources, substitute “34,019,362,000”.

Amendment of schedule 2 (direct-funded bodies)

4.  In schedule 2 to the Act, in column 2, for the amount specified—

(a)in relation to purpose 1 (Forestry Commissioners), substitute “66,850,000”;

(b)in relation to purpose 2 (Food Standards Agency), substitute “9,900,000”; and

(c)in relation to purpose 3 (Scottish Parliamentary Corporate Body), substitute “86,739,000”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Budget (Scotland) Act 2012 (“the Act”).

Article 2 amends the overall cash authorisations specified in section 4(2) and (3) of the Act in relation to the Scottish Administration, the Forestry Commissioners and Food Standards Agency.

Article 3 amends the amount of resources (other than accruing resources) that may be used for certain purposes in schedule 1 to the Act. It also amends the total amount of those resources.

Article 4 amends the amount of resources (other than accruing resources) that may be used by the Forestry Commissioners, the Food Standards Agency and the Scottish Parliamentary Corporate Body for certain purposes in schedule 2 to the Act.
