Method of questioning European Parliamentary elections79

No European Parliamentary election and no declaration of the result by the returning officer under rule 60 of the European Parliamentary elections rules shall be questioned except by a petition complaining of an undue election or undue declaration (”a European Parliamentary election petition”) presented in accordance with this Part of these Regulations.

A petition complaining that no declaration of the result has been given by the returning officer shall be deemed to be a European Parliamentary election petition and the High Court—

a

may make such order on the petition as they think expedient for compelling a declaration to be made; or

b

may allow the petition to be heard by an election court as provided with respect to ordinary European Parliamentary election petitions.

No European Parliamentary election petition may be brought on the grounds of the commission of corrupt or illegal practices, except those in regulations 23 and 25.

No European Parliamentary election petition may be brought where an application may be made under section 11 of the 2002 Act.
