This Order is made in connection with the implementation, by the Cornwall (Structural Change) Order 2008(1), of a proposal made by Cornwall County Council.

A draft of this Order was laid before and approved by a resolution of each House of Parliament in accordance with section 240(6) of the Local Government and Public Involvement in Health Act 2007(2).

The Secretary of State for Communities and Local Government makes this Order in exercise of the powers conferred by sections 7, 11, 12 and 13(1) of the Local Government and Public Involvement in Health Act 2007:

Citation and commencement

1.—(1) This Order may be cited as the Cornwall (Electoral Arrangements and Consequential Amendments) Order 2009.

(2) This Order shall come into force on the day after that on which it is made.

Interpretation

2.—(1) In this Order—

“county” means the county of Cornwall; and

“existing”, in relation to an electoral division, means the electoral division as it exists on the date on which this Order is made.

(2) In this Order—

(a)any reference to a numbered sheet is a reference to the sheet which bears that number and is marked “Sheet referred to in the Cornwall (Electoral Arrangements and Consequential Amendments) Order 2009”, and of which prints are available for inspection at—

(i)the Library and Information Centre, Communities and Local Government, 1/C8 Ashdown House, 123 Victoria Street, London SW1E 6DE; and

(ii)the principal and area offices of the council of the county; and

(b)any reference to a numbered map is a reference to the map bearing that number and contained within a numbered sheet.

Electoral divisions of the county of Cornwall and number of councillors

3.—(1) The existing electoral divisions of the county shall be abolished.

(2) The county shall be divided into 123 electoral divisions which shall bear the names set out in column (1) of the Schedule.

(3) The electoral divisions shall comprise the areas illustrated on sheet 1 and specified in column (2) of the Schedule by reference to parishes, or described in that column by reference to parts of parishes or other areas indicated on a numbered sheet, a numbered map or both a numbered sheet and a numbered map.

(4) One councillor shall be elected for each electoral division.

(5) Where a boundary is shown on the map as running along a road, railway line, footway, watercourse or similar geographical feature, it shall be treated as running along the centre line of the feature.

(6) Paragraph (1) does not affect the term of office of any person elected for an existing electoral division of the county; and any such person shall continue in office until the fourth day after the ordinary day of election of councillors in 2009.

Inspection of numbered sheets

4.  The council of the county shall make a print of the numbered sheets available for inspection by any member of the public, free of charge and at any reasonable time at—

(a)its principal office; and

(b)each of its area offices.

Electoral registers

5.  The electoral registration officer(3) shall make such rearrangement or adaptation of the register of local government electors as may be necessary for the purposes of, or in consequence of, this Order.

Consequential amendment of the County of Cornwall (Electoral Changes) Order 2005

6.  The County of Cornwall (Electoral Changes) Order 2005(4) is amended by the omission of paragraphs (2) and (3) of article 1, article 3, articles 6 to 8 and the Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order abolishes the existing 71 electoral divisions of the county of Cornwall and provides for the creation of 123 new electoral divisions. One councillor is to be elected for each electoral division. Article 3 and the Schedule make provision for the names and areas of the new electoral divisions. The new arrangements are based on draft recommendations published on 2nd December 2008 by the Boundary Committee for England, a committee of the Electoral Commission. Those recommendations may be viewed at http://www.electoralcommission.org.uk/boundary-reviews/all-reviews/south-west/cornwall/cornwall-electoral-review

The areas of the new electoral divisions are shown on the sheets described in article 2(2). Where a numbered map is referred to in column (2) of the Schedule, it will be found on the sheet of the same number. Article 4 requires the Council to make the sheets available for inspection.

Article 5 requires the electoral registration officer to make any necessary amendments to electoral registers to reflect the new electoral arrangements.

Article 6 amends the County of Cornwall (Electoral Arrangements) Order 2005 by omitting paragraphs (2) and (3) of article 1, article 3, articles 6 to 8 and the Schedule. The provisions retained relate to the warding of the parishes of Helston and Newquay (constituted by articles 4 and 5 of that Order) and the number of councillors for those parish wards.

The four-year term of office of county councillors elected in 2009 is provided for in section 6 of the Local Government Act 1972 (c.70). Section 7 of that Act determines the years in which ordinary elections of county councillors are held. After 2009, county council elections will be held in 2013 and every fourth year after that.

A full impact assessment has not been produced for this Order as no impact on the private or voluntary sector is foreseen.
