“the court” means the sheriff, and any application to the sheriff under this Part of this Act shall be disposed of in a summary manner; and

“mortgagee” means creditor in a heritable security, and “heritable security” has the same meaning as in the M1Conveyancing (Scotland) Act 1924 except that it includes a security constituted by ex facie absolute disposition or assignation.
