South Africa Act 1995

1995 CHAPTER 3

An Act to make provision in connection with the re-admission of South Africa as a member of the Commonwealth.

BE IT ENACTED by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Provisions relating to South Africa.U.K.

The provisions in the Schedule to this Act, which are made in connection with the re-admission of South Africa as a member of the Commonwealth, shall have effect.

2 Short title.U.K.

This Act may be cited as the South Africa Act 1995.

2(1)In the Schedule to the M1Imperial War Museum Act 1920 (board of trustees), in paragraph (1)—U.K.

(a)for the words “twenty other members” there shall be substituted the words “ twenty-one other members ”; and

(b)in the first and second columns of the table after the entries relating to the Government of New Zealand there shall be inserted “ 1 ” and “ The Government of South Africa ” respectively.

(2)The above amendments are without prejudice to the power to vary the said paragraph (1) conferred by section 1 of the M2Imperial War Museum Act 1955.

4U.K.In the M3Visiting Forces (British Commonwealth) Act 1933, section 4 (attachment of personnel and mutual powers of command) shall apply in relation to forces raised in South Africa as it applies to forces raised in Dominions within the meaning of the M4Statute of Westminster 1931.

5(1)In section 1(1)(a) of the M5Visiting Forces Act 1952 (countries to which Act applies), after the words “New Zealand,” there shall be inserted the words “ South Africa, ”.U.K.

(2)Any Order in Council for the time being in force under section 8 of that Act (application to visiting forces of law relating to home forces) shall be deemed to apply to the visiting forces of South Africa until express provision with respect to that country is made under that section.
