a

for subsection (9)(b) substitute—

for the appointment to chair the tribunal of a member of the Judicial Committee of the Privy Council who holds or has held high judicial office,

b

in subsection (11), before the definition of “provision” insert—

“high judicial office” has the meaning given by section 60 of the Constitutional Reform Act 2005,
