  8. Construction of Railway

    1. VI.The Construction of the Railway to be subject to the Provisions of this Act and the Lands Clauses Consolidation (Scotland) Act.

  9. Temporary Use of Lands

    1. XXV.Company may occupy temporarily private Roads within Five hundred Yards of the Railway.

    2. XXVI.Power to Owners and Occupiers of Road and Land to object that other Roads should be taken.

    3. XXVII.Power to take temporary Possession of Land without previous Payment of Price.

    4. XXVIII.Company to give Notice previous to such temporary Possession.

    5. XXIX.Service of Notices on Owners and. Occupiers of Lands.

    6. XXX.Power to Owner to object that other Lands ought to be taken.

    7. XXXI.Power to the Sheriff to summon other Owners before him.

    8. XXXII.The Company to give Sureties, if required.

    9. XXXIII.Company to separate the Lands before using them.

    10. XXXIV.Stone Quarries, &c. to be worked as Surveyor or Owner shall direct.

    11. XXXV.Owners of Lands may compel Company to purchase Lands so temporarily occupied.

  10. Lands for additional Stations

    1. LVII.Sheriff or Justices to have Power to order Repair of Bridges, &c.

    2. LVIII.Board of Trade empowered to modify the Construction of certain Roads, Bridges, &c. where a strict Compliance with the Act impossible or inconvenient.

    3. LIX.Authentication of Certificates of the Board of Trade, Service of Notices, &c.

  14. Works for Accommodation and Protection of Lands

    1. LX.Works to be erected for the Accommodation of adjoining Lands.

    2. LXI.Differences as to Accommodation Works to be settled by Sheriff or Justices.

    3. LXII.Execution of Works by Owners on default by the Company.

    4. LXIII.Power to Owners of Land to make additional Accommodation Works.

    5. LXIV.Works to be constructed under the Superintendence of the Company's Engineer.

    6. LXV.Accommodation Works not to be required after Five Years.

    7. LXVI.Owners to be allowed to cross until Accommodation Works made.

    8. LXVII.Materials, &c. to vest in Company for Purposes of Prosecution.

  15. Branch Railways

    1. LXIX.Power to Parties to make private Branch Rail, ways communicating with the Railway.

  16. Working of Mines

    1. LXX.Promoters of the Undertaking not to be entitled to Minerals.

    2. LXXI.Mines lying near the Railway not to be worked if the Company willing to purchase them.

    3. LXXII.If Company unwilling to purchase, Owner may work the Mines.

    4. LXXIII.Mining Communications.

    5. LXXIV.Company to make Compensation for Injury done to Mines ;

  17. Passengers and Goods on Railway

    4. LXXXII.Company not to be liable to a greater Extent than Common Carriers.

  18. Collection Tolls

  19. Bye Laws

    1. CI.Company to regulate the Use of the Railway.

  20. Leasing of Railway

    1. CV.Exercise of Power to lease Railway.

    2. CVI.Powers vested in Company to be exercised by Lessees.

  21. Carriages and Engines

    1. CVII.Engines to consume their Smoke.

    2. CVIII.Engines to be approved by the Company and Certificate of Approval given. Unfit Engines to be removed.

    3. CIX.Penalties on Persons using improper Engines.

    4. CX.Carriages to be constructed according to Company's Regulations.

    5. CXI.Regulations to apply also to Company's Carriages.

    6. CXII.Penalty for using improper Carriages.

    7. CXIII.Owner's Name, &c. to be registered, and exhibited on Carriages.

    8. CXIV.On Noncompliance Carriage may be removed.

    9. CXV.Carriages improperly loaded, or suffered to obstruct the Way, may be unloaded or removed.

    10. CXVI.Company not to be liable for Damage by unloading, &c.

    11. CXVII.Owners liable for Damage by Servants.

    12. CXVIII.Owners to recover from Servants.

  22. Arbitration

    1. CXIX.Where Questions are to be determined by Arbitration Arbiters to be appointed within Fourteen, Days after Notice.

    2. CXX.Vacancy of Arbiter to be supplied.

    3. CXXI.Appointment of Oversman.

    4. CXXII.Lord Ordinary to appoint an Oversman on Neglect of Arbiters.

    5. CXXIII.In case of Death of single Arbiter, Matter to begin de novo.

    6. CXXIV.If either Arbiter refuse to act, the other to proceed ex parte.

    7. CXXV.If Arbiters fail to make their Award within Twenty one Days the Matter to go to the Umpire.

    8. CXXVI.Power of Arbiters to call for Books, &c.

    9. CXXVII.Expences to be in the Discretion of the Arbiters.

    10. CXXVIII.Awards to be in Writing, and recorded.

    11. CXXIX.Not to be set aside for Matter of Form.

    12. CXXX.Service of Notices upon Company.

    13. CXXXI.Tender of Amends.

  23. Recovery of Damages and Penalties

    1. CXXXII.Provision for Damages not otherwise provided for.

    2. CXXXIII.Distress, &c. against the Treasurer.

    3. CXXXIV.Method of proceeding before the Sheriff or Justices in Questions of Damages.

    4. CXXXV.Publication of Penalties.
