Citation and interpretation

1.—(1) This order may be cited as the Medicines (Termination of Transitional Exemptions) (No. 2) Order 1974.

(2) In this order, unless the context otherwise requires, “the Act” means the Medicines Act 1968 and other expressions have the same meanings as in the Act.

(3) The rules for the construction of Acts of Parliament contained in the Interpretation Act 1889 shall apply for the purposes of the interpretation of this order as they apply for the purposes of the interpretation of an Act of Parliament.

Termination of transitional exemptions from licences for ingredients

2.  Without prejudice to the provisions of Article 2(b) of the Medicines (Termination of Transitional Exemptions) (No. 1) Order 1972(2) (wholesale dealing in certain medicinal products), the 1st September 1974 shall be the day appointed for the purposes of subsections (2) to (5) of section 16 of the Act (transitional exemptions) as being the day upon which those subsections shall cease to have effect in relation to anything done on or after that day in so far as it relates to a substance that is a medicinal product by virtue only of the provisions of section 130(1)(b) of the Act (ingredients).

EXPLANATORY NOTE

The Medicines (Termination of Transitional Exemptions) (No. 1) Order 1972 appointed 1st September 1972 as the day upon which the transitional exemptions from the licensing requirements of the Medicines Act 1968 (section 16) ceased to have effect in relation to anything done on or after that day, except in relation to ingredients that are medicinal products (section 130(1)(b) and (3) of that Act) and wholesale dealing in certain medicinal products for human use only. This order now appoints 1st September 1974 as the day for the ending of the transitional exemptions in relation to such ingredients. The order does not relate to the exception made by the earlier order in respect of wholesale dealing.
