The Immigration (Landing and Embarkation Cards) Order 1975

In exercise of the powers conferred upon me by paragraph 5 of Schedule 2 to the Immigration Act 1971, I hereby make the following Order:—

1.  This Order may be cited as the Immigration (Landing and Embarkation Cards) Order 1975 and shall come into operation on 1st March 1975.

2.  The Interpretation Act 1889 shall apply to the interpretation of this Order as it applies to the interpretation of an Act of Parliament.

3.  The Immigration (Landing and Embarkation Cards) Order 1972(1) is hereby revoked.

4.—(1) Except as provided by Article 5 a person aged 16 years or over who disembarks or embarks in the United Kingdom shall, unless he has a right of abode there under section 2 of the Immigration Act 1971 and produces a current passport issued by the Government of the United Kingdom not acting on behalf of another Government, produce to an Immigration Officer, if required a landing card or embarkation card, as the case may be, duly completed.

(2) The card shall be in such from as the Secretary of state may direct, and it shall be supplied by the owners or agents of the ship or aircraft concerned.

5.  This Order shall not apply to a person disembarking from or embarking on a ship or aircraft coming from or going to a place in the common travel area unless he is a person who, disembarking from an aircraft coming from the Republic of Ireland., entered the Republic on a journey to the United Kingdom which had begun outside the common travel area and was not given leave to land in the Republic in accordance with the law in force there.

EXPLANATORY NOTE

This Order, revoking and replacing the Immigration (Landing and Embarkation Cards) Order 1972, extends the categories of persons required to produce landing or embarkation cards when disembarking or embarking in the United Kingdom. While under the previous Order cards were required from aliens only, Article 4 of the new Order makes the requirement general, except for persons travelling on United Kingdom passports who are partial, i.e. who have under section 2 of the Immigration Act 1971 the right of abode in the United Kingdom. Like the previous Order, this Order does not extend to persons travelling within the common travel area (the United Kingdom, the Channel Islands, the Isle of Man and the Republic of Ireland) except in the case of a person landing form an aircraft coming from the Republic of Ireland who began his journey outside the common travel area and was not given leave to land in the Republic. (Travellers within the common travel area may however be required to produce cards under the Prevention of Terrorism (Supplemental Temporary Provisions) Order 1974 (S.I. 1974/1975) and the Prevention of Terrorism (Supplemental Temporary Provisions) (Northern Ireland) Order 1974 (S.I. 1974/2038).)
