The Maintenance Orders (Facilities for Enforcement) (Revocation) Order 1979

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred by section 19 of the Maintenance Orders Act 1958, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1.  This Order may be cited as the Maintenance Orders (Facilities for Enforcement) (Revocation) Order 1979 and shall come into operation on 1st April 1979.

2.—(1) Insofar as the Maintenance Orders (Facilities for Enforcement) Order 1959 provides that the Maintenance Orders (Facilities for Enforcement) Act 1920 shall extend to the countries and territories specified in paragraph (2) below, that Order is hereby revoked, and accordingly the names of those countries and territories shall be omitted from the First Schedule to that Order.

(2) The countries and territories referred to in paragraph (1) above are—

  • Alberta;

  • Fiji;

  • Hong Kong;

  • Norfolk Island;

  • Saskatchewan;

  • Singapore;

  • Turks and Caicos Islands;

  • Western Australia.

3.  The Maintenance Orders (Facilities for Enforcement) (Tanganyika) Order 1964 is hereby revoked.

EXPLANATORY NOTE

Article 2 of this Order revokes the Maintenance Orders (Facilities for Enforcement) Order 1959 insofar as it extends the Maintenance Orders (Facilities for Enforcement) Act 1920 to Alberta, Fiji, Hong Kong, Norfolk Island, Saskatchewan, Singapore, Turks and Caicos Islands and Western Australia. Article 3 of this Order revokes the Maintenance Orders (Facilities for Enforcement) (Tanganyika) Order 1964 which extended the Act of 1920 to Tanganyika. These countries and territories are designated as reciprocating countries for the purposes of Part I of the Maintenance Orders (Reciprocal Enforcement) Act 1972 (c. 18) by the Reciprocal Enforcement of Maintenance Orders (Designation of Reciprocating Countries) Order 1979 (S.I. 1979/115) which comes into operation on the same date as this Order.
