The Secretary of State for Social Services, in exercise of the powers conferred upon him by sections 39(1) and 168(1) of, and Schedule 20 to, the Social Security Act 1975(1) and of all other powers enabling him in that behalf, after agreement with the Social Security Advisory Committee that proposals to make these regulations should not be referred to it(2), hereby makes the following regulations:—

2. For paragraph (a) of regulation 10 of the principal regulations (conditions for entitlement to a Category D retirement pension) there shall be substituted—
“(a)was resident in Great Britain for a period of at least 10 years in any continuous period of 20 years which included the day before that on which he attained the age of 80 or any day thereafter; and”
3. A person's failure to satisfy the old condition of entitlement contained in regulation 10(a) of the principal regulations as made, shall not prevent his becoming entitled hereafter by satisfying the new condition which is substituted by these regulations.

These regulations amend regulation 10 of the Social Security (Widow's Benefit and Retirement Pensions) Regulations 1979 (conditions for entitlement to a Category D retirement pension) by substituting for paragraph (a) a requirement that to be entitled to Category D retirement pension a person must have resided in Great Britain for an aggregate period of at least 10 years in any continuous period of 20 years which includes the day before he attains the age of 80 or any day thereafter. Persons who failed to satisfy the former regulation 10(a) may satisfy the new condition from 26th November 1984.
section 39(1) was amended by section 5(1) of and Schedule 1, paragraph 2 to the Social Security Act 1979 (c. 18).
