The Secretary of State for Social Services, in exercise of the powers conferred on him by section 49(a) of, and Schedule 20 to, the Social Security Act 1975(1) and section 28(1) of the Social Security and Housing Benefits Act 1982, and, insofar as is required in the case of regulation 3, with the consent of the Treasury(2) and after consultation with organisations appearing to him to be representative of authorities concerned(3), by this instrument, which contains only provisions consequential on Schedule 4 to the Health and Social Security Act 1984 before the expiry of the period of six months beginning with the commencement of that Schedule, makes the following regulations:—

Citation and commencement

1.  These regulations may be cited as the Social Security Benefit (Dependency) and Housing Benefits Amendment Regulations 1984 and shall come into operation on 29th November 1984.

Amendment of the Social Security Benefit (Dependency) Regulations 1977

2.  Regulations 1(3)(a) and 12(1) of the Social Security Benefit (Dependency) Regulations 1977(4) shall each be amended by substituting for the words “non-contributory invalidity pension” the words “severe disablement allowance”.

Amendment of the Housing Benefits Regulations 1982

3.  In regulation 18(6C) of the Housing Benefits Regulations 1982(5), for the words “non-contributory invalidity pension” there shall be substituted the words “severe disablement allowance”.

EXPLANATORY NOTE

These regulations amend the Social Security Benefit (Dependency) Regulations 1977 and the Housing Benefits Regulations 1982. They are consequential on Schedule 4 to the Health and Social Security Act 1984 and are made within six months of the commencement of that Schedule, that is 10th September 1984. Accordingly they are, by virtue of section 22(1)(c) of that Act, exempt from the requirement of section 10(1) of the Social Security Act 1980/(c.30) to refer proposals to the Social Security Advisory Committee and are made without reference to that Committee.

Section 11 of, and Schedule 4 to, the 1984 Act provide that non-contributory invalidity pension under section 36 of the Social Security Act 1975 shall be replaced by a new benefit called severe disablement allowance. These regulations substitute, for references to the old benefit in regulations 1(3) and 12(1) of the Social Security Benefit (Dependency) Regulations 1977 and regulation 18(6C) of the Housing Benefits Regulations 1982, references to the new benefit.
