The Diseases of Fish Act 1983 (Commencement) Order 1984

In exercise of the powers conferred on them by section 11(2) and (3) of the Diseases of Fish Act 1983, and of all other powers enabling them in that behalf, the Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, hereby make the following order:—

Citation and interpretation

1.—(1) This order may be cited as the Diseases of Fish Act 1983 (Commencement) Order 1984.

(2) In this order “the Act” means the Diseases of Fish Act 1983 and “the 1937 Act” means the Diseases of Fish Act 1937.

Appointed day

2.  The Act shall come into force on 1st April 1984.

Transitional provisions

3.  In the application of this order to Scotland and subject to section 11(5) of the Act, any order made, and anything done, under section 2 of the 1937 Act and having effect immediately before the coming into force of the Act shall have effect as if made or done under the said section 2 as amended by the Act, and for the purpose of this article any reference in any such order to an area declared to be an infected area shall be treated as if it were a reference to an area designated by an order under the said section 2 as amended by the Act.

EXPLANATORY NOTE

This Order brings into force the provisions of the Diseases of Fish Act 1983 on 1st April 1984.

In its application to Scotland, it preserves the effect of existing orders and other things done under section 2 of the Diseases of Fish Act 1937, which contains provisions in relation to areas declared to be infected in terms of that Act.
