The Employment Agencies Act 1973 (Exemption) (No. 2) Regulations 1984

The Secretary of State, in exercise of the powers conferred on him by sections 12(1) and 13(7)(i) of the Employment Agencies Act 1973 and of all other powers enabling him in that behalf, and after consultation as required by section 12(2) of the said Act with bodies appearing to him to be representative of the interests concerned, hereby makes the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Employment Agencies Act 1973 (Exemption) (No. 2) Regulations 1984 and shall come into operation on 7th August 1984.

(2) In these Regulations:—

local law societyhas the meaning assigned to it by section 87(1) of the Solicitors Act 1974;

the first 1979 Regulations” means the Employment Agencies Act 1973 (Exemption) Regulations 1979;

the second 1979 Regulations” means the Employment Agencies Act 1973 (Exemption) (No. 2) Regulations 1979;

the 1982 Regulations” means the Employment Agencies Act 1973 (Exemption) Regulations 1982;

the 1984 Regulations” means the Employment Agencies Act 1973 (Exemption) Regulations 1984.

Revocation

2.  The first 1979 Regulations, the 1982 Regulations and the 1984 Regulations are hereby revoked.

Amendment of the second 1979 Regulations

3.  There shall be omitted from the second 1979 Regulations—

(a)sub-paragraphs (a) and (b) of paragraph (1) of Regulation 2;

(b)sub-paragraph (a) of paragraph (2) of Regulation 2; and

(c)the Schedule to those Regulations.

Exemption

4.  The Employment Agencies Act 1973 shall not apply to any business carried on, or any services provided by,—

(a)the organisations listed in Part I of the Schedule to these Regulations;

(b)an organisation, or a company established by such an organisation, being an organisation or company listed in Part II of the said Schedule.

EXPLANATORY NOTE

These Regulations replace three previous sets of Regulations and part of a fourth set. Their effect is to prescribe bodies with the result that under the Employment Agencies Act 1973 any businesses carried on and any services provided by those bodies are exempt from the provisions of the Act; the Regulations which they replace, in whole or in part, limited the exemptions to specific activities of the bodies named therein. There are some changes to the list of bodies now exempted.
