FOREIGN COMPENSATION

Coming into Operation

Whereas the Foreign Compensation Commission have, in exercise of their powers under section 4(2) and (3) of the Foreign Compensation Act 1950, after consultation with the Council on Tribunals, made rules of procedure and submitted them to the Lord Chancellor for his approval:

Now, therefore, the Lord Chancellor, in exercise of the powers conferred on him by sections 4(2) and 8(3) of the said Act, after consultation with the Council on Tribunals, hereby approves the said rules in the form set out in the Schedule hereto.

This Instrument may be cited as the Foreign Compensation Commission (Czechoslovakia) (Amendment) Rules Approval Instrument 1985 and shall come into operation on 3rd June 1985.

SCHEDULE

The Foreign Compensation Commission, in exercise of their powers under section 4(2) and (3) of the Foreign Compensation Act 1950, after consultation with the Council on Tribunals, hereby make the following Rules:—

These Rules may be cited as the Foreign Compensation Commission (Czechoslovakia) (Amendment) Rules 1985.

The Foreign Compensation Commission (Czechoslovakia) Rules 19821 shall be amended by inserting after sub-paragraph (d) of paragraph 1 of rule 37 the following sub-paragraph:—

dd

in the case of an applicant other than a corporation, any person who satisfies the Commission that he is a relative or personal friend of the applicant he proposes to represent and that he has the authority of the applicant to represent him in that behalf.

EXPLANATORY NOTE

Under the Foreign Compensation Commission (Czechoslovakia) Rules 1982 an applicant may appear before the Commission in person or be represented by a barrister or solicitor. The purpose of these amending Rules is to provide that an applicant may also be represented by a relative or personal friend who has the authority of the applicant to represent him in that behalf.
