Coming into Operation

The Secretary of State for Transport as respects England and the Secretary of State for Wales as respects Wales in exercise of the powers conferred by section 90C(5) of the Highways Act 19801, and after consultation with representative organisations in accordance with section 90C(6) of that Act, hereby makes the following Regulations:—

Citation and commencement1

These Regulations may be cited as the Highways (Road Humps) (Local Inquiries) Regulations 1986 and shall come into operation on 1st December 1986.

Modification of subsections (4) and (5) of section 250 of the Local Government Act 19722

In subsections (4) and (5) of section 250 of the Local Government Act 1972 (Ministers' powers in relation to costs arising out of certain local inquiries), as having effect in relation to inquiries held in pursuance of section 90C(4) of the Highways Act 1980 by virtue of subsection (5) of that section, references to “Minister” shall, in the case of a local inquiry held under the said section 90C(4) by a local highway authority, be construed as references to “local highway authority”.

EXPLANATORY NOTE

These Regulations amend subsections (4) and (5) of section 250 of the Local Government Act 1972 in their application to local inquiries held in pursuance of section 90C(4) of the Highways Act 1980 by a local highway authority.
